Dutch municipalities are confronted with an increased number of prescribed environmental tasks and also with a growing demand, both from the central government and environmental pressure groups, to undertake environmental activities on their own initiative. This development over-taxed the information management of most municipalities. In the past few years, computer technology was introduced to relieve part of this pressure (e.g., by automation of registration systems). In this article we present a classification of computer applications for environmental management, investigate their possible (...) impact on the environmental knowledge and information system, and distinguish between a formal and informal knowledge domain. This paper presents a theory of reasoning with evidence in order to determine the facts in a criminal case. The focus is on the process of proof, in which the facts of the case are determined, rather than on related legal issues, such as the admissibility of evidence. In the literature, two approaches to reasoning with evidence can be distinguished, one argument-based and one story-based. In an argument-based approach to reasoning with evidence, the reasons for and against the occurrence of (...) an event, e.g., based on witness testimony, are central. In a story-based approach, evidence is evaluated and interpreted from the perspective of the factual stories as they may have occurred in a case, e.g., as they are defended by the prosecution. In this paper, we argue that both arguments and narratives are relevant and useful in the reasoning with and interpretation of evidence. Therefore, a hybrid approach is proposed and formally developed, doing justice to both the argument-based and the narrative-based perspective. By the formalization of the theory and the associated graphical representations, our proposal is the basis for the design of software developed as a tool to make sense of the evidence in complex cases. Van Koppen and Mackor offer a scenario‐approach analysis of the case. They first explicate their approach, linking it to inference to the best explanation and theories of explanatory coherence. An important distinction in their analysis is between explaining known facts and predicting novel facts. They claim that their approach is cognitively feasible and stays close to descriptive theories of evidential reasoning. They want to keep it informal, so that legal professionals can apply it.

The United Nations (UN) Universal Declaration of Human Rights engenders important state commitments to respect, fulfill, and protect a broad range of socio-economic rights. In 2010, a milestone was reached when the UN General Assembly recognized the human right to safe and clean drinking water and sanitation. However, water plays an important role in realizing other human rights such as the right to food and livelihoods, and in realizing the Convention on the Elimination of All Forms of Discrimination against Women. (...) These broader water-related rights have been recognized but have not yet been operationalized. This paper unravels these broader water-related rights in a more holistic interpretation of existing international human rights law. By focusing on an emerging approach to water services provision—known as ‘domestic-plus’ services—the paper argues how this approach operationalizes a comprehensive range of socio-economic rights in rural and peri-urban areas. Domestic-plus services provide water for domestic and productive uses around homesteads, which challenges the widespread practice in the public sector of planning and designing water infrastructure for a single-use. Evidence is presented to show that people in rural communities are already using their water supplies planned for domestic uses to support a wide range of productive activities. Domestic-plus services recognize and plan for these multiple-uses, while respecting the priority for clean and safe drinking water. The paper concludes that domestic-plus services operationalize the obligation to progressively fulfill a comprehensive range of indivisible socio-economic rights in rural and peri-urban areas. Governmental and non-governmentalagencies worldwide have devoted considerablefinancial, technical, and organizational efforts toconstruct or rehabilitate irrigation infrastructure inthe last three decades. Although rural povertyalleviation was often one of their aims, evidenceshows that rights to irrigated land and water wererarely vested in poor men, and even less in poorwomen. In spite of the strong role of irrigationagencies in vesting rights to irrigated land and waterin some people and not in others, the importance ofagencies‘ targeting practices is still ignored.This article disentangles how public (...) irrigationagencies either included or excluded women and mensmallholders as right holders to irrigated land andwater. This is done on the basis of significant casestudies from Africa, Asia, and Latin America thatpoint in both positive and negative directions. Thegeneral conclusions are the following. Rights toirrigated land are related to the site-selection andphysical design of land-bound irrigationinfrastructure. These rights are vested in the pooreither by implementing a localized land reform or bydirectly selecting poor people‘s land forimprovement. Among all potential land users in aselected site, water rights have to be defined. Thepoor are included as title holders if water rights arevested in land users rather than land owners, and inboth women and men, rather than in male householdheads. A common condition to get water rights is thatone has to participate in construction investments.Agencies need, firstly, to open up this condition forthe poor, also for women, and, secondly, ensure thatpoor people‘s investments are linked to rights.Parallel to vesting land and water rights, externalagencies influence the composition of the local forumsin which decisions on land and water rights arerefined, endorsed, and implemented, and they influencethe order in which project activities are planned andundertaken. Early inclusion of the poor in theseforums and crystallization of expropriation andallocation criteria and procedures before constructionstarts are pivotal for poverty alleviation. (shrink)

In this article, we want to reply to the recent article by Buturovic, to be able to correct some statements and allegations about this combined procedure. Organ donation after euthanasia is an extremely difficult procedure from an ethical point of view. On the one hand, we see a suffering patient who wants to die but who also wants to make an altruistic effort to donate his organs. On the other hand, we visualise a patient in need of an organ but (...) who is wary of the fact that someone else needs to die in order to potentially receive a transplant organ. Healthcare professionals seem to walk a tightrope when balancing between the interests of the patients at these two extremes: while facilitating the dying patient’s last wish on the one hand and abiding by all regulations regarding donation and transplantation on the other. Yet, these physicians, nurses and transplant coordinators do their utmost best to keep a strict line between euthanasia and organ donation, to avoid any external pressure on the patient, and to respect his autonomy. They really make an utmost attempt to make the process bearable for the donating patient. However, undeniably the patient who is about to undergo organ donation after euthanasia is nevertheless confronted with dozens of feelings and thoughts. However, this does not imply that procedural safeguards are failing to disentangle organ donation from euthanasia. (shrink)

We start with an overview of signaling games with a conflict of interest between sender and receiver, and show that the literature on such games can be classified into models with direct, costly, noisy and imprecise signals. We study the life story of a former SS Leibstandarte soldier and we focus on the way the narrator deals with face threats by negotiating his identity constructions. The interviewee positions himself as a sportsman and an ignorant soldier, thus constructing denial of knowledge of and agreement with Hitler's ideology. These identities can be considered to be complementary, but they are built in quite different ways: the narrator explicitly presents himself as a sportsman, but mitigates his implicit construction of ignorance. Given the social and historical context, this contrast in degree of explicitness is expected since the ignorance claim has been the subject of many previous discourses and debates of this subject. The European Union affects the internal organisation of national political parties. We found 'traces of Europe' in the party statutes of all Belgian parties that are represented in the European Parliament since 1999. Europe is, to a greater or lesser extent, present in party goals, rules on party membership and party organs. Parties have elaborated rules for the organisation of European elections, for the selection of European executives, for the formulation of party programmes, and for internal and external co-ordination of (...) policy formulation. At first sight these rules seem to confirm the hypothesis that Europe is in the first place a concern of party leadership, and that it reinforces centralisation of decision-making. Yet the full confirmation of this hypothesis requires further comparative research on the Europeanisation of political parties. (shrink)

Although DNA profiling has been an important forensic research technique since the late 1980s, for a long time, it had not captured much attention from either academics or the public so far.In recent years, this neglect seems to have ended. Not only has wide-spread media coverage of events such as 9/11 and the 2004 tsunami brought about widespread knowledge of the usefulness of forensic DNA identification, the development of large databases containing DNA profiles of both suspected and convicted criminals has (...) in the last few years also triggered a discussion on the intrusiveness of these measures into a number of civil rights.Indeed, although the increasing use of DNA based techniques in the criminal justice system promises to offer some great benefits for a society that is permeated with risk-aversion, at the same time it also gives rise to some worrying ethical and social consequences.In this article, we confine ourselves to an analysis of the practice of DNA sample retention by government agencies that use these samples to derive digital storable DNA profiles. While this practice seems unnecessary for the purpose of criminal investigation, it carries some severe risks for genetic privacy rights which have hardly been explored so far. (shrink)

Universities and other research institutions are increasingly providing additional training in research integrity to improve the quality and reliability of research. Various training courses have been developed, with diverse learning goals and content. Despite the importance of training that focuses on moral character and professional virtues, there remains a lack of training that adopts a virtue ethics approach. To address this, we, a European Commission-funded consortium, have designed a train-the-trainer programme for research integrity. The programme is based on (1) virtue (...) ethics, (2) the ethos of science, (3) learning by doing and (4) learner-centred teaching. The blended learning programme combines e-learning modules with participatory group sessions. Trainers are taught how to guide researchers through a series of structured exercises for fostering reflection on scientific virtues, and how to promote understanding and application of the European Code of Conduct for Research Integrity. Trainers are provided with adaptable tools and resources that can be used and combined in different ways. The programme implementation began in Spring 2020 and 470 trainers have participated to date. When trainers were asked to grade – between 0 (very bad) and 10 (excellent) – the e-learning modules and the participatory exercises, 60% scored a grade 8 or higher (median = 8, IQR = 2) for the e-learning modules, whereas 80% scored a grade 8 or higher (median = 9, IQR = 1) for the participatory exercises. A majority felt that the training helped them as a trainer to learn about ways to organise and teach a research integrity course (82%) and would recommend the interactive exercises to others (92%). Trainers have educated over 3300 researchers in Europe using our virtue-based approach. The VIRT2UE train-the-trainer programme fosters research integrity by providing trainers with exercises and tools which enable them to stimulate the development of good researchers across Europe. While ethical and empirical interest in so-called secondary variants and incidental findings in clinical genetics contexts is growing, critical reflection on the ethical foundations of the various recommendations proposed is thus far largely lacking. We examine and critique the ethical justifications of the three most prominent disclosure positions: briefly, the clinical geneticist decides, a joint decision, and the patient decides. Subsequently, instead of immediately developing a new disclosure option, we explore relevant foundational ethical values and norms, drawing on the normative (...) and empirical ethical literature. Four ethical signposts are thereby developed to help guide disclosure discussions. These are: respectful sharing of the clinician’s expertise; transparent communication; epistemic modesty; and respect for the embedded nature of the patient. We conclude by considering the most common current disclosure positions in the light of the four ethical signposts. (shrink)

To investigate whether people can implicitly learn regularities in a social context, we developed a new implicit sequence learning task combining elements from classic false belief and serial reaction time tasks. Participants learned that protagonists were offered flowers at four locations. The protagonists' beliefs concerning the flowers were true or false, depending on their orientation, respectively, toward the scene or away from it. Unbeknown to the participants, there was a fixed belief-related sequence involving three dimensions. Participants had to indicate as (...) fast as possible where the flowers were located, or how many flowers were given according to the protagonists. Experiment 1 combined perceptual and motor processes, whereas Experiment 2 unconfounded the sequence and motor responses, allowing to investigate pure perceptual implicit learning. For reasons of comparison, two non-social conditions were created in Experiment 2 by replacing the protagonists with two non-social objects—colored cameras or shapes. Results revealed significant implicit sequence learning of all belief-related dimensions in Experiment 1, and of true-false belief orientation in Experiment 2, even without a motor confound. Importantly, there were faster reaction times and stronger sequence learning effects in the social than in the non-social conditions. The present findings demonstrate for the first time that people are able to implicitly learn belief-related sequences. (shrink)

Peter van Inwagen presented a powerful argument against the Principle of Sufficient Reason, which I henceforth abbreviate as ‘PSR’. For decades, the consensus was that this argument successfully refuted PSR. However, now a growing consensus holds that van Inwagen’s argument is fatally flawed, at least when ‘sufficient reason’ is understood in terms of ground, for on this understanding, an ineliminable premiss of van Inwagen’s argument is demonstrably false and cannot be repaired. I will argue that this growing consensus is mistaken (...) and that a powerful argument relevantly similar to van Inwagen’s should still concern us, even when we understand ‘sufficient reason’ in terms of ground. The generally accepted idea of the "decline ofparties" leads to an obvious assumption on the evolution of party activism : it must be declining. There is however only little empirical research on this topic. We conduct a survey among party members in Belgium, in order to test the decline hypothesis. Four dimensions of membership wilt be measured: the numbers, the intensity of participation, the kind of participation and the turnover.

Democracy is intimately linked with the institution of parliament. If there are problems with the functioning of the parliament, democracy is considered as being in danger. Three kinds of problems are aften raised in this respect : technical problems, politica! problems and personnel problems. The technical problems refer to the technicity and complexity of the subjects to be dealt with in parliament. The political problems refer mainly to the loss of political power of the parliament, to the benefit of political (...) parties and pressure groups. The personnel problems refer to the job of MP itself, which has become a full-time job, but which is still a very unstable position.Two hundred and fifty Belgian MP's were asked for their opinion about all this. The results show that they are primarily concerned with the technical problems, and that they suggest technical remedies for a better functioning of the parliament. The Belgian MP's do recognize the importance of the political problems, especially the domination of the political scene by the political parties, but they are not very eager to propose measures with a direct impact on this. Multi-level governance is a fairly new concept, that has however travelled well in modern political science. The status of the concept remains a bit unclear, mainly because it tries to grasp quite a set of societal and institutional changes, as well as changes in policy style and policy outputs. We try to use multi-level governance as a heuristic tool, and we focus on the potential consequences of the changes that it describes. Four types of consequences are briefly discussed. First we (...) look at efficiency, at the way in which and the degree in which complex institutions can produce policy paralysis. Secondly we deal with representation and accountability, discussing the meaning of these concepts in multilayered settings. Then we look at the way in which territorial representation seems to gain importance as a result of the erosion of the borderlines between domestic and international polities. And finally we look at the way in which legitimacy of politicalauthorities and policies can be organized within the framework of multi-level governance. The other articles of this special issue all deal in more detail with one or more of these four types of consequences of multi-level governance. (shrink)

Max Weber's century old thesis on christian ethics and the spirit of capitalism, has been the object of an endless discussion. This has much to do with the interest of the author: Weber was neither intrigued by the fact of a connection between protestantism and capitalism, nor by the influence of Calvinism on the development of the modern capitalism. His interest, however, was exclusively focused on the question 'how can the relation between protestant ethic and capitalism be conceived and reconstructed'. (...) We try to explain many misconceptions by recovering what Weber really has said. Therefore the concepts of 'spirit of capitalism' and 'protestant ethic' are clarified and discussed. First, the spirit of capitalism is not an economic system, but an ethos. The definition of it in respect with the content, the motivation, the aim, and morality is elaborated in a comparison with the commercial ethos of the Middle Ages and the Renaissance. This makes clear that Weber's first concern was an analysis of the origin of the modern spirit, not as an intellectual construction, but as an expression of behavior. Second, we investigate what is meant by the terms 'protestantism' and 'ethics' and what the religious roots of the new spirit are: innerworldly ascetism, the notion of calling, and the concepts of wealth and poverty. It is no wonder that there was a lot of criticism because Weber's writings on the above topic were situated on the crossroads of sociology, theology, history and economy. We present and comment on the main criticisms: protestantism rejects capitalism; the spirit of capitalism is much older than the Reformation; there is no monocausal relation between the protestant ethic and the spirit of capitalism; the role of catholicism in this development was as/more important in the rise of capitalism. Most of these criticisms result from a superficial presentation of Weber's writings and explanations in his own Anticritics, and don't do justice to Weber's 'idealtypische' and 'verstehende' approach. This approach was not intended to give a complete and exhaustive 'last' explanation of the essence of a social phenomenon. (shrink)

In classical speculation on medical matters health is conceived of as a bodily statewhich is in accordance with Nature. It is a state of natural balance in the mixture (complexio) of the primary qualities of the human body. Although few of the details in theancient natural philosophy and the Galenic philosophy of health have survived, it is important to note that two of the ancient ideas still influence the thoughts: the idea ofa balance between opposing elements or forces, and, in (...) particular, the idea of a natural or normal state of the living organism. In the actual reflection there is a forceful attempt to formulate a conception of health and disease in terms of biological norms where the interpretation is unambiguous. According to this conception the biological norms are related to certain natural goals (e.g. survival). These goals are not attributed to the body for the outside, but belong to the internal constitution of the body. In this paper the author wants to present the essential tenets and main merits of such a theory, more precisely the bio-statistical theory of the American philosopher Christopher Boorse. In a second phase he points out a critical assessment of this perspective, mainly focussing on the claims of a value-free scientific approach and of neutrality. (shrink)

In this paper, I investigate the possibility of a rich account of ecological restoration. Starting from the apparent one-sided focus on science and technology within the nature conservation community in Flanders, Belgium, I first present an intuitive case against a restorative practice solely based on science and technology. I then argue that what constitutes good restorative practice must be informed by the historical Arcadian tradition in which nature appreciation and subsequent conservation in the West have taken shape. However, the way (...) in which nature is perceived through that tradition seems highly external and stylized, and thus the question can be raised whether restorative practices based on this tradition can do nature itself any justice. Following the lead of Dutch sociologist Kris van Koppen, I argue that it can when the tradition is made flexible through a “conversation process” with nature. Such a conversation process can beachieved by engaging people in a sensual and bodily way in the restoration process. The result is that the richer account of the restorative practice contributes to the constitution of meaningful places that resist easy manipulation through science and technology. (shrink)

This paper assesses the contribution of Karl Polanyi, a theorist largely ignored in fascism scholarship, toward understanding fascism’s interwar rise and present-day implications. In exploring Polanyi’s work in The Great Transformation and lesser-known and unpublished writings, a sophisticated and largely original conception of fascism emerges, rooted in the idea of ‘anti-individualism’ as its foundational trait. Polanyi accounts for fascism’s philosophical content, ideological plasticity, political function and societal form, intervening in debates over how to define fascism, its ambiguity with the populist (...) far-right, and on its both economically reactionary and socially revolutionary qualities. Polanyi’s analysis suggests an enduring vulnerability on the part of liberal capitalism to fascist currents as (1) a solution to the instability of the market economy (and broader incompatibility between capitalism and democracy) at the systemic level, and (2) to the crisis of the individual subject on a social and moral level. I end by considering how Polanyi’s theory might be applied to locate current neo-fascist movements and elucidate the sociological problems underpinning their existence. (shrink)

Kris McDaniel argues that there are different ways in which things exist. For instance, past things don't exist in the same way as present things. Numbers don't exist in the same way as physical objects; nor do holes, which are real, but less real than what they are in. McDaniel's theory of being illuminates a wide range of metaphysical topics.

In this paper, I formulate, elucidate, and defend a version of modal realism with overlap, the view that objects are literally present at more than one possible world. The version that I defend has several interesting features: (i) it is committed to an ontological distinction between regions of spacetime and material objects; (ii) it is committed to compositional pluralism, which is the doctrine that there is more than one fundamental part-whole relation; and (iii) it is the modal analogue of endurantism, (...) which is the doctrine that objects persist through time by being wholly present at each moment they are located. While it is widely accepted that music evokes moods, there is disagreement over whether music-induced moods are relevant to the aesthetic appreciation of music as such. The arguments against the aesthetic relevance of music-induced moods are: moods cannot be intentionally directed at the music and music-induced moods are highly subjective experiences and are therefore a kind of mind-wandering. This paper presents a novel account of musical moods that avoids these objections. It is correct to say that a listener’s entire mood (...) is not relevant to the aesthetic appreciation of music. However, the experience of mood consists of having different feelings. Music induces feelings that are intentionally directed at the music and clusters of these feelings can be recognized as typical of a specific mood. Therefore, mood-feelings are relevant to the aesthetic appreciation of music. (shrink)
